Duration of a Divorce Process

How long does it take to get a divorce?

The end of a marriage is also the end of what many would call a "family unit." Divorce proceedings can often be as lengthy and involve establishing a new family.

To determine how long it takes to get a divorce, you first have to figure out how long the divorce process is.

Process In Filing A Divorce

The whole process usually begins with one spouse filing for divorce. This is the Petitioner in legal terms, and the other spouse is the Respondent.

Once you've filed for divorce, you'll have your first court date within 30 days. You'll need to bring documents to prove that you meet all of your state's requirements for a no-fault divorce, and that's why it's so important to talk to an attorney before filing.

The next step will be mediation, which may or may not be required by your jurisdiction. Mediation allows both spouses to sit with a trained mediator who will help guide the discussion toward reaching an agreement outside of court.

If the parties cannot reach an agreement, then they will move on to trial. A trial begins with jury selection (if applicable), then opening statements from each side, and finally, testimony from witnesses called by each party.

Getting a divorce is an emotionally trying process—it's not just signing the paperwork and moving on. There are a lot of legal and financial issues that need to be addressed.
