Child Violating a Custody Agreement
What happens when the child violates the custody agreement?
There are two things that can happen if a child is in violation. The first is that the court may, of course, order that the child returns to the original custodian. However, this is not a given and entirely depends on what's in the child's best interest.
The second is that the custodian may have legal recourse to enforce their rights under an action for contempt. This means they can request a court hearing, and if they're successful, they will be granted an order to remedy whatever has happened.
This could mean anything from requiring the return of a child to order that one parent pay punitive damages (such as compensation for attorney's fees incurred). In any case, this is only appropriate for serious violations such as failure to pay agreed-upon support and/or failure to comply with reasonable visitation schedules.
Importance of Custody Agreement
It's important to note that each state has statutes to enforce custody orders. For example, some states have specific penalties for non-compliance while others don't. It's always best to consult your attorney regarding your situation and what remedies are available in your area.
Knowing what happens when the child violates the custody agreement is important. The court has the right to take action, and parents should always follow the law. Getting a qualified attorney to help you can ensure that you protect your rights.
