When a couple gets divorced, it is not uncommon for one partner to claim that the other partner is “wasting money” on their divorce attorney. The person who is making the accusation often takes this position because he or she believes that it is the other party’s job to pay for the legal fees in the divorce. The reason for this belief is simple: these people believe that, in a divorce, each party should be responsible for paying his or her own attorney fees.

But this is not the case. In fact, each state has different laws about who pays attorney fees in a divorce. In many states, either spouse can be ordered to pay the attorney fees of both parties. However, one spouse can be required to pay only his or her own attorney fees, and not those of his or her spouse, if certain conditions are met (such as where there was domestic violence).
