If you’re in charge of a loved one’s final affairs, you may be confused about the difference between an executor and a power of attorney. An executor is the person responsible for carrying out the family member’s wishes, as laid out in a will or trust. A person named as a power of attorney, on the other hand, has the right to make decisions for someone who is incapacitated.

A power of attorney carries more weight in your life than an executor. It’s something that can be used at any time while the person is still alive and well. You can use it so they can make decisions for you if you’re unable to do so yourself. The other term usually shows up after someone has died, when someone is needed to carry out their last wishes by disposing of their remaining assets and distributing them according to the terms of their will or trust.
