A custody agreement is a legal document that lays out the details of the day-to-day custody of a child or children. It must be approved by the court and states the terms and procedures that will be followed. Generally, parents must live within minutes of each other, which can be determined by a court-approved parenting plan.

The agreement will outline how the parents will share the time spent with the child. This is important for the child's adjustment to the new situation. In addition, the parties must work together to maintain the consistency of routines between their households, including mealtimes, bedtimes, and homework. They must also ensure that they don't let third parties interfere with their parenting relationship or make disparaging comments about the other parent.

The age of the child is also a factor in establishing custody schedules. Young children have the ability to form lasting memories of family life. Parents must work together to make sure that their children are not stressed by separation anxiety. This can be accomplished by creating provisions that govern how the children will be dropped off and picked up from each parent.

In addition to establishing the time spent with the child, a custody order will include the Standard Possession Order (SPO). This document will establish how each parent will have access to the child. The custody order will refer to parenting time as possession or access, and will set a schedule for the time spent with each parent. For example, a basic SPO will allow the noncustodial parent to have possession of the child on Thursday evenings, weekends, alternating holidays, and for at least one month in the summer. It will also tell parents where and when they can exchange the child with the other parent. The standard possession order will also have special rules for those parents who live more than 100 miles apart.
