Bankruptcy is a complicated matter, and it’s important to understand the difference between a bankruptcy attorney and a bankruptcy petition preparer. A petition preparer is not a lawyer, but they can help you fill out the forms you need to file for bankruptcy. They are not allowed to give you legal advice, or explain the contents of your petition in any way.

A bankruptcy petition preparer isn’t required to be licensed in any particular state—anyone with basic computer skills can set up shop as a petition preparer. Some states have mandatory licensing requirements for petition preparers, but most do not.

Bankruptcy attorneys, on the other hand, are licensed by the state bar association and have graduated from law school. Bankruptcy attorneys can advise clients about their rights and obligations during a bankruptcy case; provide legal representation during the process; and work toward settling debts outside of bankruptcy court.
