What is the statute of limitations for personal injury cases?
The statute of limitations for personal injury cases is 3 years in the state of California. This means that a plaintiff must file a lawsuit within three years from the date of the incident or from when they first knew about it, whichever occurs later.
There are some exceptions to this rule, though. For example, if someone tells you about the incident and you don't realize that it happened until sometime after the fact, then you have three years from when you realize that it happened. If a doctor has told you that there were no injuries and then later finds out that there were, then you get 3 years from when the doctor found out.
In order to find out how long your case will take to resolve (that is, how long you will be dealing with the court system), you need to speak with an attorney and find out how far along your case is in terms of getting ready for trial. Once the attorneys have finished gathering evidence, they will be able to tell you how much time remains in your case. This should not be confused with how long your case will last once it goes to trial and all evidence has been presented; this only applies to getting things prepared for court proceedings.
