Many people think that all personal injury claims go to court. In fact, the majority of personal injury cases are settled out of court, though there are a few circumstances under which they are taken to trial. The main difference between the two is that in a settlement, both parties agree on the compensation amount and the injured party waives their right to take legal action against the other party. The compensation amount often includes money for medical bills, pain and suffering damages, and lost wages (in the case of an accident at work). When an injury goes to trial, the judge or jury decides how much money should be awarded to either side. While it may seem like it's easier to just settle out of court, this can actually be a risky move. If you settle without consulting an attorney, you could miss out on getting more money than you would have if you had gone to trial. You also might be signing away your right to any damages that you might have been entitled to in court—this isn't necessarily true, but it's better not to risk it.
