The estate of a deceased person may pursue a lawsuit that was not finalized or settled prior to their death. While this may seem like an obvious statement, there are many elements that go into determining whether or not the estate can legally proceed with the suit as originally intended. In order to make this determination, one must first understand why this issue arises.

For example, let's say that Joe and Jane Doe had a son named John who died in a car accident in 2015. Prior to his death, John was involved in a high-profile civil suit against another driver named Sally Brown over the serious injuries he sustained in the accident (including paralysis of his legs). John Doe left instructions for his legal counsel to settle the case one way or the other before his death. but unfortunately his instructions were either not clear enough or not followed closely enough by those in charge of managing his affairs after he died. The case proceeded without resolution until it came up on the court docket again this year (2016).
