When you lose a loved one, you're faced with many legal matters and administrative details; due to the complexity of estate administration, most people choose to hire a probate attorney to help them navigate this process. Depending on the circumstances of your case and the jurisdiction in which you live, there may be times when you're required to appear in court. Here are some common scenarios in which you may need to visit a probate court:
-You're an heir who has requested an inventory and accounting of the estate.
-You want to challenge the will or one of its provisions.
-You want to distribute the decedent's assets via a petition for distribution.

When must I appear in probate court?

If you are a beneficiary or an heir (i.e., someone who inherits property from the deceased) under a will or the law, you must attend probate court once a petition for probate is filed. You may be asked to verify information about yourself and answer questions about the deceased and his/her assets. If you are not a beneficiary or an heir, you do not have to attend probate court. However, if you are interested in what is happening in probate court, you may attend any time the case is open.
