What is the difference between personal injury and negligence?

Even for those of us who have paid attention in other law classes, there's a lot here to unpack. Personal injury law is designed to compensate victims for the harm they experienced, while negligence law is designed to hold people responsible for their actions that cause harm to others.

The difference between the two lies in the way they determine whether someone deserves compensation. In personal injury cases, you win by proving your case on a balance of probabilities - basically, if it seems more likely than not that you were injured and another party caused it, you win. On the other hand, in negligence cases, you win by proving your case beyond a reasonable doubt - if it seems impossible that anyone could blame the defendant for causing your injuries, then there's no negligence.

To be successful with a negligence claim, your lawyer will have to show three things: duty (a legal obligation to act a certain way); breach (failure to live up to the standard) and causation (the result caused by the breach of duty).
