What Happens If My Divorce Case Is Dismissed?

One of the reasons that a case may be dismissed is because one spouse didn't cooperate in the process. Most judges will dismiss your case if you don't go to a scheduled hearing or fail to provide the documents that were requested. But there's more! If you lied about anything in your petition for divorce or with any of the documents you filed, lied during a hearing or deposition, or didn't follow through on any of your court responsibilities—for example, by failing to pay child support—your case could be dismissed. Judges take these things seriously because they want you to be able to afford an attorney and participate in your own divorce.

The answer is that there are many reasons why your case could be dismissed, but most of them boil down to one big issue: failure to provide information or to attend hearings when required. If a judge rules that you failed to attend court as required or didn't provide the necessary information, the outcome will be dismissal. You'll have no choice but to start over, and re-file, incurring additional legal fees along the way. You should also know that if your spouse files for a modification or change of the terms of the agreement between you two, then the court will not approve it unless an attorney for you both signs off on it. This means that if you want to make changes and your spouse won't sign off on them, then your case will be dismissed as well.
