Upon the filing of a divorce petition, the court will issue an order designating who is responsible for various aspects of the marital estate. This order is known as a "decree," and it is usually signed by both parties to the divorce. A decree is not necessary for a divorce to be finalized; however, it does play an important role in determining how property and debt are divided between spouses in the event of a divorce. Although divorces are typically uncontested and do not need to go before a judge, the court will still require an official document signed by both parties in order to finalize the dissolution of the marriage. If one spouse refuses to sign the decree, this could affect his or her ability to receive alimony or child support payments from the other party.
