An annulment is not the same thing as a divorce. In fact, it's the opposite. In dissolving a marriage, a divorce court recognizes that the marriage never existed in the first place. An annulment is a court ruling that says even if the marriage did exist, it has now been invalidated—that it was wrongly entered into and therefore should be unmade.

An annulment is a declaration made by a court that a marriage never legally existed. Annulments are not granted because of irreconcilable differences or because the marriage was only for immigration purposes. Instead, they are usually granted on the grounds that one of the parties was already married to someone else at the time of the marriage. This can happen if there were fraudulent statements made to obtain a divorce or separation, and then remarriage without obtaining an annulment.
