The executor must be answerable to the beneficiaries of the will. He or she must follow the directions in the will as to how the estate should be divided. The executor is not responsible for other debts and liabilities of the deceased person. The executor also has some legal responsibilities to other people. For instance, they may have to pay off any loans that have been taken out by the deceased person before distributing the rest of the assets. An executor may also have to make sure that property owned jointly by the deceased person with someone else is transferred properly. If there are debts attached to joint property (for example, a mortgage), then it is necessary for both parties to agree on who is going to handle this debt.

The person who has the authority to settle an estate is called the executor. That person should also be named in the will as a co-executor, so that there is a backup if he or she cannot fulfill their duties as executor at any given time.
