If you're getting divorced and your wife refuses to sign the divorce papers, what does that mean for you? There are some things you can do—and some things you can't. If she is thinking about not signing the papers, then she may be considering reconciliation. If this is the case, or if she has refused to sign on principle because she's trying to make a point, then there isn't much you can do.

Virtually every state requires one party's signature on a divorce decree. The rules differ by state as to whether this means both parties have to be in agreement to the divorce or whether it only needs one party's signature—but in every case, if one party refuses to sign, then the other party is unable to file for divorce.

If your wife won't sign the papers, your first step should be to try and talk her into doing so. If you're getting divorced because of an affair and/or domestic violence, then this could be a major factor in her refusal. If it's not something that can be worked out with conversation, consider taking her before a judge who could order her to sign the papers.
