If One Spouse Sells The House During A Divorce Without The Other Spouse Knowing, What Happens?
If one spouse sells the house during a divorce without the other spouse knowing, what happens?
In North Carolina, if a property has no beneficiary designated in the deed, then it will be awarded to the owner's current spouse. This can result in a situation where an unsuspecting party is suddenly burdened with the responsibility of maintaining a home that he or she may have had little choice in buying.
The law is different in every jurisdiction and it would be wise to consult with an attorney if you are experiencing this problem.
If you're in the process of getting a divorce and have not yet decided what to do with your house, one of the best things you can do for yourself is to make sure your spouse (or soon-to-be-ex) doesn't sell the house without telling you first.
I know this sounds like a really easy thing to avoid doing. But if there's any animosity between you and your spouse, they might suddenly decide they need to get rid of the house as quickly as possible, and will sell it, even if it means taking less than what it's worth. You'll want to be able to decide whether or not you want to sell the home with them, or if you'd rather buy them out so that you can begin a new chapter in your life elsewhere.
